Campus Restricted Data List and Data Proprietor List

Restricted data are any data whose use is restricted by law, University of California or UC Berkeley policy, or by a campus data proprietor as the result of a formal risk assessment. For example, use of student information is restricted by FERPA, medical information, by HIPAA, and personal information about employees, donors and research subjects, by the California Information Practices Act (IPA). The term "data" is interchangeable with "information", and restricted information can be in both electronic and non-electronic form (ie., in a database, or written on a piece of paper.)

In an enterprise as extensive and diverse as Berkeley , it is impossible to comprehensively catalog all restricted data. However, as a service to the campus, the Data Stewardship Council compiles information about restricted data into a restricted data list. This list is neither official nor exhaustive. Therefore, you should consider the data elements and information items that appear on this list to be “most probably” restricted data, until such time as this list is made official. You should also use this list as an aid for thinking about other data that you are in possession of, which don't appear on this list, but might also be considered restricted data.

Restricted data are not all the same – different privacy, confidentiality, security, and publication requirements will apply. A good general rule is that if you have a server, computer, application, or paper files, etc. that contains any data, which appears on this list or is similar to data that appears on this list, you should, 1) remove the data immediately if it is not necessary to keep, or 2) contact the appropriate campus data proprietor for accurate information about restrictions for the data's use and requirements for its protection. The Data Stewardship Council also compiles information on campus data proprietors into a list. Like the restricted data list, it is not an official or complete list, but it should at least help you point your questions in the right direction.
